Terms and Conditions
§ 1 Scope
(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded via the online shop starlink-b2b.com between GARAMBOO HELLAS MON IKE (hereinafter "Seller" or "we") and its customers (hereinafter "Customer"), regardless of whether they are consumers or entrepreneurs.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity.
(3) Deviating, conflicting or supplementary General Terms and Conditions of the customer shall not become part of the contract, unless we expressly agree to their validity in writing.
§ 2 Contracting party, conclusion of contract
(1) The purchase contract is concluded with GARAMBOO HELLAS MON IKE, K. Kartali 64-68, 382 21 Volos, Greece.
(2) The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to the customer to order goods.
(3) By clicking the order button, the customer submits a binding offer to purchase the goods contained in the shopping cart. The purchase contract is concluded when we accept the order by means of an order confirmation via e-mail, but at the latest upon dispatch of the goods.
§ 3 Prices, shipping costs
(1) All stated prices are exclusive of the statutory value added tax, unless otherwise stated, and exclusive of shipping costs.
(2) The respective valid shipping costs can be viewed on our shipping costs page and will be displayed to the customer in the checkout before completing the order.
§ 4 Payment terms
(1) Payment is made at the customer's choice via the payment methods offered in the ordering process (see payment methods page), including credit card, digital wallets or advance payment by bank transfer.
(2) For advance payment, the purchase price is due immediately after conclusion of the contract. The goods will be shipped as soon as the full amount has been received in our account.
§ 5 Delivery, transfer of risk
(1) Delivery is made to the delivery address specified by the customer. Details on delivery areas and times can be found on the shipping costs page.
(2) For consumers, the risk of accidental loss and accidental deterioration of the sold goods passes only when the goods are handed over to the consumer, regardless of whether the shipment is insured or uninsured.
(3) For entrepreneurs, the risk passes upon handover of the goods to the transport company.
§ 6 Retention of title
The delivered goods remain the property of GARAMBOO HELLAS MON IKE until full payment of the purchase price.
§ 7 Warranty
(1) The statutory liability for defects applies.
(2) For entrepreneurs, the warranty period for used goods is one year from delivery of the goods, if legally permissible.
§ 8 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. Details can be found in the cancellation policy on our website. There is no right of withdrawal for entrepreneurs.
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act.
(2) For slight negligence, we are only liable for the breach of an essential contractual obligation (cardinal obligation), the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the customer may regularly rely; in this case, liability is limited to the foreseeable, typical damage for the contract.
(3) The foregoing limitations of liability do not apply in the event of injury to life, body or health.
§ 10 Applicable law, place of jurisdiction
(1) For contracts with entrepreneurs, Greek law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Volos, Greece.
(2) For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
§ 11 Final provisions
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
